Cancellation and Refund Policy

Issued by UIC Mobilya Turizm Sanayi ve Ticaret Ltd. Şti. operating under the brand Amitai Cruises Travel Agency.
Prepared in accordance with Law No. 1618 (Travel Agencies Law), TÜRSAB Regulations, Law No. 6502 on Consumer Protection, GDPR/KVKK, and ICC Force Majeure principles.

1. General Provisions

  • All cancellation or amendment requests must be submitted in writing to info@amitaicruises.com.
  • Refunds are processed only to the original payer and through the original payment method.
  • Bank, credit card, or payment gateway commissions are non-refundable.
  • Refunds for foreign-currency payments are issued in the same currency; exchange-rate differences are borne by the customer.
  • Government taxes, airport fees, duties, and insurance premiums are non-refundable.
  • No-Show (failure to participate) results in forfeiture of the full amount.
  • Services already commenced or completed are non-refundable.

2. Deposits and Pre-Payments

  • Deposits or advance payments are non-refundable and applied toward the total amount.
  • Reservations without deposit payment may be cancelled unilaterally by the Company.

3. Payment Methods

  • Virtual POS: Refunds to the same card only; processing may take 7–14 business days; bank fees deducted.
  • Link POS: Refunds to the same card; platform charges non-refundable; chargeback rules of the issuing bank apply.
  • Mail Order: Refunds to the same card only; mail-order commissions non-refundable; chargeback decisions binding.
  • Bank Transfer / EFT: Refunds to the same account within 7 business days.
  • Installment Payments: Refund installments follow the bank’s posting schedule; the Company is not liable for such timing.

4. Cultural & Guided Tours

  • Cancellation ≥ 30 days before departure → 85% refund (15% retention).
  • 29–15 days → 40% refund; ≤ 14 days → no refund.
  • Museum/entrance tickets, guide fees, and transport costs are non-refundable.
  • If group participation becomes insufficient, the Company may cancel the tour and issue a full refund.
  • Visa refusal, missing documents, or personal reasons do not entitle any refund.
  • Partial participation or early departure is non-refundable.

5. Package Tours

  • ≥ 30 days prior → 90% refund (10% deduction).
  • 29–15 days → 50% refund; ≤ 14 days → no refund.
  • Each included service is also subject to its own specific cancellation terms.

6. Flight Tickets

  • Airline fare rules apply.
  • Promotional/discount tickets are non-refundable.
  • Date/name changes subject to additional fees.
  • Flight delays or cancellations fall under the airline’s responsibility per international air-transport conventions.

7. Cruise Reservations

  • Cruise-line terms prevail; the Company acts solely as an intermediary.
  • Promotional or discounted fares are non-refundable.
  • Date or passenger changes subject to cruise-line charges.

8. Accommodation (Hotel / Villa / Yacht)

  • Facility-specific cancellation policies apply.
  • Non-refundable reservations yield no refund under any circumstance.
  • No refund for late check-in or no-show.
  • In yacht charters, fuel, crew, and preparation costs are non-refundable.

9. Transfer Services

  • ≥ 72 hours before service → 80% refund (20% retention).
  • 72–24 hours → 50% refund; < 24 hours or no-show → no refund.
  • Flight cancellations/delays may lead to rescheduling subject to provider approval and extra cost.

10. Special Services & Insurance

Visa consultancy, travel insurance, private vehicle rental, and event tickets are non-refundable. Discounted student/child fares and statutory taxes or duties are also non-refundable.

11. Group Reservations

For groups of 10 or more participants, separate cancellation terms apply and may include stricter penalties according to contractual conditions.

12. Force Majeure

In cases of natural disasters, pandemics, wars, strikes, technical failures, or government actions recognized internationally as force majeure, refund conditions are governed by the relevant service provider’s policies. The Company shall not be held liable in such circumstances.

13. Refund Request Period

Refund applications must be made prior to service commencement. No refund rights arise after the start or completion of a service.

14. Data Protection

Personal data collected during booking and payment are used solely for service provision and refund processing, protected under KVKK & GDPR. No data are shared beyond lawful necessity.

15. Refund Processing Timeline

  • Approved refund requests are processed within 14 business days.
  • Credit-card refunds appear within 7–14 business days (subject to bank posting).
  • Bank-transfer refunds completed within 7 business days.

16. Complaints & Dispute Resolution

  • Complaints must first be submitted in writing to the Company.
  • If unresolved, jurisdiction lies with the TÜRSAB Arbitration Board and Consumer Arbitration Committees.
  • For litigation, Istanbul Anadolu Courts and Execution Offices have exclusive jurisdiction.
  • Mandatory rules of international consumer law remain unaffected for foreign customers.
